What to Expect:

• 10:00 AM: Start your day at the iconic Chapter One Café in Bondi. Enjoy a coffee, tea, or matcha while mingling with fellow singles. Please arrive NO LATER THAN 10:30!
• 11:00 AM - 1:00 PM: Embark on a scenic walk from Bondi to Coogee, led by our friendly host. Along the way, you'll have plenty of opportunities to connect with like-minded singles.
• Stops Along the Way: We'll pause in Bronte and Clovelly for some brief relaxation, hydration, toilet stops and photo opportunities.
• 1:00 PM - 2:30 PM: For those who are keen, we will stop at FNKY Coogee Beach, where a welcome drink awaits you. You can continue mingling over a well-deserved lunch if you feeling peckish

TERMS AND CONDITIONS OF ENTRY & PARTICIPATION (INCL. RECREATIONAL ACTIVITY WAIVER)

These terms and conditions (the “Form”) apply to the above event (the “Event”) and associated activities conducted by Merge Dating (the “Operator”).

Please read this entire form carefully before agreeing. Each participant must click "Yes" on the order form for this waiver agreement to indicate their acceptance. By clicking "Yes," I acknowledge that I accept the terms and conditions outlined. "I" or "me" refers to myself as the participant.

Voluntary Participation. I understand and confirm that my participation in the Event is voluntary. I am in good health and suffer from no physical or mental condition that would make me susceptible to injury or disability while participating in the Event.

Understanding Risks. I am aware of the risks, dangers and hazards involved in my participation in the Event. My participation in the Event may involve exposure to the risk of injury, death, permanent disability or damage to my property and other risks outlined below, which list of risks is not exhaustive. Any such injury or loss may result not only from my actions but from the actions, omissions or negligence of others. I understand that the Event takes place in public venues and locations under conditions largely beyond the control of the Operator. Potential risks may include, but are not limited to, uneven walking surfaces, potholes, raised path edges, wet or slippery ground, steps, curbs, low lighting, narrow walkways, traffic movement, road crossings, diversions due to construction or exposure to weather conditions. I have received sufficient warning or otherwise satisfied myself of all risks associated in participating in the Event, I participate in the Event at my own risk and I acknowledge that the assumption of risk and warnings contained in this section constitutes a 'risk warning' in accordance with relevant legislation, including the Australian Consumer Law and Civil Liability Act 2002 (NSW).

Assuming Risks. I assume all risks involved in participation in the Event provided by the Operator. I accept personal responsibility for any liability, injury, loss, or damage in any way connected with my participation in the Event. I am responsible for the security of my possessions (including phones and other personal possessions) at the Event and the Operator and its Released Entities will not be liable for damage to or replacement of these possessions.

Recreational Activity Waiver and Exclusion of Liability. I acknowledge and agree that where I am a consumer of recreational services (as that term is defined in the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law or any relevant State or Territory law) (“recreational services”), certain terms and rights usually implied into a contract for the supply of goods or services may be excluded. I acknowledge that these implied terms and rights and any liability of the Operator and the Released Entities flowing from them, are expressly excluded, restricted or modified as set out below.

By agreeing to this Form, you agree that the liability of the Operator in relation to the supply of recreational services and recreational activities (as that term is defined in the Civil Liability Act 2002 (NSW)) for any:

a. death;

b. illness;

c. physical or mental injury (including the aggravation, acceleration or recurrence of such an injury);

d. the contraction, aggravation or acceleration of a disease;

e. the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs:

i. that is or may be harmful or disadvantageous to you or the community; or

ii. that may result in harm or disadvantage to you or the community,

that may be suffered by you resulting from the Event is excluded. The application of any express or implied term that any recreational services or recreational activities: (a) will be provided with due care and skill; (b) are reasonably fit for any purpose which you, either expressly or by implication, make known to the Operator; and (c) might reasonably be expected to achieve any result you have made known to the Operator, is hereby excluded. For the avoidance of doubt, this exclusion does not exclude liability for recklessness as defined by any relevant law.

Notwithstanding the above, nothing in this Form excludes or limits any right, remedy, guarantee, warranty or any other term or condition implied or imposed by the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (including any consumer guarantee) or any relevant State or Territory law which cannot be lawfully excluded or limited. For any liability which cannot lawfully be excluded but can be limited under the Australian Consumer Law, the Operator’s liability is limited to the maximum extent permitted by law to the price of the Operator’s entry fee for the Event, re-supplying your opportunity to participate in the same Event at a later time, or supplying a substitute entry for another Operator event that is satisfactory to you.

Release of Liability. I release, waive, discharge and covenant not to sue the Operator, its principals, affiliated entities, parent companies, subsidiaries, present and former employees, owners, officers, members, managers, partners, contractors, insurers, shareholders, and directors (collectively “Released Entities”) from any and all claims, actions, damages, liabilities, losses, costs, and expenses for death, injury, loss or damage of property, in any way arising out of my participation in the Event, including, without limitation, any and all claims resulting from the negligence of the Released Entities.

Indemnity Agreement. I indemnify and hold harmless the Operator and Released Entities from any loss, liability, damage or cost that they may incur for losses and damages which may be brought against me or against any of them by anyone claiming to be injured (including death) or whose property is damaged as a result of my actions arising from or during the Event.

Severability. If any portion of this Form or Waiver is held to be invalid it is agreed that the balance of the agreement will remain valid and enforceable.

Promotion Release. I agree to grant to the Operator a royalty-free license to use my photographic, video, or digital likeness, in whole or in part, taken during the Event, solely for promotional and educational purposes.

Consent to Medical Treatment. I authorise the Operator to provide me with customary medical assistance, transportation, and emergency medical services as the result of injury or health condition. This consent does not impose a duty upon the Operator to provide such assistance, transportation, or services. I have the right to refuse medical assistance and understand the Operator will provide assistance if I am incapacitated.

By purchasing a ticket, I confirm that I have carefully read, understood, and voluntarily agree to participate in the event. I also understand that this agreement is legally binding upon me, as well as my executors, administrators, and other personal representatives, and I agree to be bound by its terms and conditions.
